HOUSE CONCURRENT
RESOLUTION
urging the board of land and natural RESOURCES to offer leases of public land located in koke‘E STATE PARK THROUGH A PUBLIC LOTTERY SYSTEM.
WHEREAS, Koke‘e State Park is located on the island of Kauai; and
WHEREAS, in 2008, the Legislature created the Koke‘e State Park Advisory Council to manage and preserve the Koke‘e State Park; and
WHEREAS, the Legislature also required the Board of Land and Natural Resources to renegotiate the recreation-residence use leases for lessees residing Koke‘e State Park; and
WHEREAS, pursuant to Act 223, Session Laws of Hawaii 2008, if a lessee fails to renegotiate the lease, the Board of Land and Natural Resources is required to offer the recreation-residence use lease through a public auction; and
WHEREAS, a public auction, while effective for obtaining the highest price, eliminates individuals who do not have the economic means to out-bid investors or individuals seeking vacation or transient use of Koke‘e State Park; and
WHEREAS, a public lottery system, administered by the Board of Land and Natural Resources, will allow each applicant, regardless of financial resources, to have a chance at the recreation-residence use leases; and
WHEREAS, the individuals dedicated to residing in, maintaining, and preserving Koke‘e State Park generally do not have the economic means to compete in an auction; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that Legislature urges the Board of Land and Natural Resources to offer leases of public land located in Koke‘e State Park through a public lottery system; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to Chairperson of the Board of Land and Natural Resources and the Chairperson of the Koke‘e State Park Advisory Council.
