A BILL FOR AN ACT


 

 

relating to libraries.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  Act 246, Session Laws of Hawaii 2005, established a school impact fee working group to develop a template or process for requiring fair share contributions from private land developers of residential developments to defray a portion of the cost of providing department of education facilities.

     The result of the efforts of the working group was the enactment of Act 245, Session Laws of Hawaii 2007, that set forth a new method for financing, in part, new and expanding existing department of education school facilities in partnership with developers of new residential development, by identifying need areas and calculating appropriate school impact fee for new residential developments.

     The purpose of this Act is to establish a working group to develop a similar template or process for requiring fair share contributions from private developers of residential developments for the development of public library facilities.

     SECTION 2.  (a)  There is established a library impact fee working group (working group) that shall be administratively attached to the department of education.

     (b)  The working group shall be composed of the following officials or the officials' designated representative:

     (1)  The president of the senate;

     (2)  The speaker of the house of representatives;

     (3)  The chairperson of the board of education;

     (4)  The superintendent of education;

     (5)  The state librarian;

     (6)  The executive officer of the land use commission;

     (7)  A department of education employee whose principal area of responsibility is school facilities development; and

     (8)  The executive director of the Land Use Research Foundation.

     (c)  The working group shall:

     (1)  Examine the present need for library facilities statewide, preferably based on established school impact districts or high school complexes;

     (2)  Determine the differing library facility needs for each district or complex area, including but not limited to:

         (A)  New and expanded facility needs;

         (B)  The needs required by different types and market groups of residential developments; and

         (C)  The different type of curricula and programs that may be required by different types of library facilities;

     (3)  Consider various funding mechanisms and other best practices utilized by other jurisdictions nationwide for the provision of library facilities;

     (4)  Consider including in the existing school impact fees process contained in chapter 302A, Hawaii Revised Statutes, a provision for library impact fees; and

     (5)  Any other matters that may be appropriate for the working group to consider.

     SECTION 3.  The working group shall submit its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2010.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2009-2010 for the operation of the working group.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2009; provided that this Act shall be repealed on June 30, 2010.
