A BILL FOR AN ACT
RELATING TO CAPITAL IMPROVEMENT PROJECTS FOR THE BENEFIT OF THE FIRST REPRESENTATIVE DISTRICT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The director of finance is authorized to issue general obligation bonds in the sum of $ or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2010-2011 for capital improvement projects for the first representative district, as follows:
1. Haaheo school, Hawaii
A. Plans, design, and construction for pedestrian safety improvement.
Install sidewalk along Haaheo road that leads to the school.

2. Honokaa elementary school, Hawaii

SECTION 2. Act 158, Session Laws of Hawaii 2008, is amended by adding a new section to read as follows:
"SECTION 5.1 Provided that the appropriation made for the capital improvement project authorized by item 127.01 of section 5 shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date."
SECTION 3. Act 158, Session Laws of Hawaii 2008, section 5, is amended by amending Item 127.01 to read as follows:
"127.01. HAW, MANONO CAMPUS AND WEST HAWAII EDUCATION CENTER DEVELOPMENTS, HAWAII
PLANS, DESIGN, CONSTRUCTION, AND EQUIPMENT FOR THE RENOVATION OF EXISTING FACILITIES AT HAWAII COMMUNITY COLLEGE MANONO CAMPUS AND SITE AND INFRASTRUCTURE IMPROVEMENTS FOR THE WEST HAWAII EDUCATION CENTER. PROJECT TO RENOVATE EXISTING FACILITIES, DEVELOP INFRASTRUCTURE, GROUND AND SITE IMPROVEMENTS, EQUIPMENT AND APPURTENANCES, AND ALL RELATED PROJECT COSTS.

SECTION 4. Act 162, Session Laws of Hawaii 2009, is amended by adding a new section to read as follows:
"SECTION 73.1 Provided that the appropriation made for the capital improvement project authorized by Act 213, section 125, item 89 of the Session Laws of Hawaii 2007, as amended by Act 162, section 73(4) of the Session Laws of Hawaii 2009, shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date."
SECTION 5. Act 162, Session Laws of Hawaii 2009, section 62, is amended as follows:
1. By amending Item 106 to read:
"106. HAW, [EAST HAWAII MANONO CAMPUS BUILDING
RENOVATION AND] NEW WEST HAWAII EDUCATION CENTER, HAWAII
PLANS,
DESIGN, CONSTRUCTION, AND EQUIPMENT FOR THE [RENOVATION OF THE HAWAII
COMMUNITY COLLEGE MANONO CAMPUS AND FOR THE] DEVELOPMENT OF THE NEW HAWAII
COMMUNITY COLLEGE WEST HAWAII EDUCATION CENTER TO INCLUDE GROUND AND SITE
IMPROVEMENTS, EQUIPMENT, APPURTENANCES, AND ALL RELATED PROJECT COSTS.

SECTION 6. The appropriation made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date.
SECTION 7. The sum appropriated for the respective capital projects set forth in section 1 shall be expended by the designated expending agency for the purposes of this Act as follows:
(1) The sums appropriated in items 1 through 3 shall be expended by the department of education;
(2) The sums appropriated by items 4 through 6 shall be expended by the department of agriculture;
(3) The sums appropriated in items 7 through 8 shall be expended by the Hawaii health systems corporation;
(4) The sums appropriated in items 9 through 10 shall be expended by the department of Hawaiian home lands;
(5) The sums appropriated in items 11 through 12 shall be expended by the department of land and natural resources;
(6) The sums appropriated in item 13 shall be expended by the department of transportation;
(7) The sums appropriated in item 14 shall be expended by the University of Hawaii;
(8) The sums appropriated in item 15 shall be expended by the county of Hawaii;
(9) The sums appropriated in item 16 shall be expended by the county of Hawaii, department of public works; and
(10) The sums appropriated in items 17 through 19 shall be expended by the county of Hawaii, department of water supply.
SECTION 8. This Act shall take effect on July 1, 2010.
