A BILL FOR AN ACT
relating to damage to a place of burial.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Damage to a place of burial. (1) A person commits the offense of damage to a place of burial if the person negligently or intentionally damages a place of burial.
(2) Any person convicted of committing the offense of damage to a place of burial shall be sentenced to a term of imprisonment of not more than one year, a fine of not more than $10,000, or both.
(3) As used in this section, "place of burial" means a place dedicated to and used for the permanent interment of human remains."
SECTION 2. This Act does not affect rights and duties that
matured, penalties that were incurred, and proceedings that were begun before
its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
