A BILL FOR AN ACT
RELATING to the boating special fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the board of land and natural resources is transferring funds out of the boating special fund for purposes other than the repair, maintenance, and capital improvements of boating facilities.
The purpose of this Act is to support the recreational renaissance of the State's boating facilities by ensuring that mooring fees and other fees associated with the use of the harbors remain within the boating special fund and are used only for the repair, maintenance, and capital improvements of recreational harbors for a period of five years.
SECTION 2. Notwithstanding any law to the contrary, the board of land and natural resources shall not transfer any funds from the boating special fund under section 248-8, Hawaii Revised Statutes, for purposes other than to reserve funds to repair, maintain, and pay for capital improvements of the State's boating facilities under the jurisdiction of the department of land and natural resources.
SECTION 3. This Act shall take effect on July 1, 2010 and shall be repealed on June 30, 2015.
