A BILL FOR AN ACT
relating to case managers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:
"Chapter
CERTIFIED CASE MANAGERS
§ ‑1 Definitions. As used in this chapter, unless the context clearly requires otherwise:
"Case management" means a holistic, comprehensive, multidisciplinary approach to the assessment, planning, coordination, implementation, monitoring, and evaluation of comprehensive services to optimally meet an individual client's health and social needs.
"Case manager" means a health care professional who:
(1) Is responsible for coordinating the health and social care delivered to an assigned individual or group of clients based on diagnosis or need;
(2) Conducts client and family education, advocacy, management of delays in provision of services, and monitoring and management of client outcomes; and
(3) Coordinates and cooperates with all relevant entities to obtain needed health and social care for the best value for a client.
"Certified case manager" means a case manager who has obtained certification required by this chapter.
"Department" means the department of commerce and consumer affairs.
"Director" means the director of commerce and consumer affairs.
§ ‑2 Certification required. Except as otherwise provided in this chapter, no case manager shall:
(1) Represent oneself as a certified case manager;
(2) Imply, in any manner, that the case manager is a certified case manager; or
(3) Use the abbreviation "C.C.M." or any other words, letters, signs, or devices to identify the case manager as a certified case manager;
without having first obtained certification required by the department under this chapter.
§ ‑3 Qualifications of certified case managers; certification by department. To practice as a certified case manager in the State, the department shall require a case manager to pass the national certification examination administered by the Commission for Case Manager Certification required for certification by the Commission. Upon receipt of documentation from the case manager of certification by the Commission to the satisfaction of the director, the department shall certify the case manager as a certified case manager.
§ ‑4 Rules. The department shall adopt rules in accordance with chapter 91 to carry out the effect of this chapter."
SECTION 2. This Act shall take effect upon its approval.
