A BILL FOR AN ACT
RELATING TO HOME OCCUPATIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Home occupation. (a) Notwithstanding any law to the contrary, the owner of a home occupation may:
(1) Employ up to two non-occupant, non-family member employees;
(2) Receive one courier visit per day, excluding deliveries by the United States Postal Service; and
(3) Service up to five customers per day.
(b) A county may regulate activities of owners of home occupations that are disruptive to the surrounding neighborhood, or are a source of unreasonable noise or noxious fumes.
(c) For the purposes of this section, "home occupation" means a business operated from a residential dwelling by the owner-occupant of the residential dwelling."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
