A BILL FOR AN ACT


 

 

RELATING TO HEALTH CARE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Upon receipt of federal funding allocated by a measure identified by Congress as a 2009 economic stimulus package, there is appropriated out of such revenues the sum of $          or so much thereof as may be necessary for fiscal year 2009-2010, and the same sum or so much thereof as may be necessary for fiscal year 2010-2011 to finance the following:

A.   Increased Medicaid reimbursements        $      

B.   Disproportionate share hospital payments $      

C.   Hawaii children's health care program    $      

     The sums appropriated shall be expended by the department of health for the purposes of this Act; provided that the level of general funds appropriated in fiscal year 2008-2009, for the programs identified in this Act shall not in fiscal years 2009-2010 and 2010-2011, be:

(1)  Replaced by the federal funds appropriated by this Act; nor

(2)  Decreased because of the availability of the federal funds appropriated by this Act;

provided further that the governor may approve the expenditure of federal funds in excess of levels authorized by the legislature only in the event that the expenditure is made for the benefit of the public.

     SECTION 2.  This Act shall take effect on July 1, 2009.
