A BILL FOR AN ACT
relating to resisting an order to stop a motor vehicle.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 710-1027, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Resisting an order to stop a motor
vehicle is [a]:
(a) A
misdemeanor[.];
(b) A class C felony if resisting an order to stop a motor vehicle places the person committing the offense, the pursuing officer, or the general public, in danger of injury or death; or
(c) A class B felony if:
(i) The person committing the offense has previously been convicted under subsection (a) or (b);
(ii) It results directly and proximately in the death of or injury to any person; or
(iii) It is done to avoid arrest and involves the wilful, reckless operation of a motor vehicle."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
