SENATE CONCURRENT

RESOLUTION

 

 

requesting the auditor to conduct a sunrise review of the registration of resident managers.

 

 


     WHEREAS, resident managers perform many important functions for condominiums, cooperative housing corporations, and planned unit developments; and

 

     WHEREAS, resident managers frequently have access to buildings and facilities, including individual units, for purposes of maintenance and upkeep; and

 

     WHEREAS, resident managers are often responsible for enforcing house rules and otherwise acting on behalf of unit owners, owners' associations, and association boards of directors; and

 

     WHEREAS, resident managers are not specifically subject to regulation or oversight by any government body; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, requires that "[n]ew regulatory measures being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing or other regulatory controls shall be referred to the auditor for analysis"; and

 

     WHEREAS, S.B. No.    , introduced during the 2010 Regular Session, proposes the registration with the Real Estate Commission of resident managers who are employed by an association of a condominium, cooperative housing corporation, or planned unit development; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the House of Representatives concurring, that the Auditor is requested to perform a sunrise review of resident managers and assess whether the enactment of regulatory measures contained in S.B. No.     is consistent with the policies set forth in section 26H-2, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to report any findings and recommendations, including an assessment of alternate regulatory frameworks other than the one contained in S.B. No.    , to the Legislature no later than twenty days prior to the convening of the Regular Session of 2011; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor, the Real Estate Commission, and the Director of Commerce and Consumer Affairs.
