A BILL FOR AN ACT

RELATING TO KAENA POINT STATE PARK.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 184, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§184‑   Kaena point state park; overnight camping; permitted. The department of land and natural resources shall permit overnight camping at Kaena point state park, subject to rules adopted pursuant to chapter 91."

     SECTION 2.  The department of land and natural resources shall adopt rules specific to the unique character and uses of Kaena point state park to permit overnight camping.  However, if the department of land and natural resources has not adopted rules to permit overnight camping at Kaena point state park by July 1, 2010, then overnight camping shall be permitted subject to title 13, chapter 146, Hawaii state park system, Hawaii Administrative Rules.

     SECTION 3.  The department of land and natural resources shall submit a report on the progress of rule adoption pursuant to this Act to the legislature no later than twenty days prior to the convening of the 2010 regular session.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval; provided that section 1 shall take effect on July 1, 2010.
