A BILL FOR AN ACT

 

 

relating to the department of health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  Chapter 334, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§334‑    Four-year state plan.  (a)  The department shall develop and implement a four-year state plan reflecting plans developed in each of the service areas by the department, as described in section 334-3(c).  The four-year state plan shall highlight plans for special populations and shall indicate what proportion of the department's budget for the mental health system is to be spent on each part of the continuum of services and each location of service delivery.  The proportion of resources directed towards mental health and substance abuse services and to children, adults, and the elderly shall also be presented.

     (b)  The allocations for residential services shall be separately shown for those services delivered in a consumer's home and those delivered in a comprehensive range of small, homelike community treatment and rehabilitation facilities.

     (c)  The allocations for hospital settings shall be separately shown for those services delivered in short-term and long-term facilities.

     (d)  The council shall review and provide comments on the four-year state plan.  The department shall review the four-year state plan every four years and update the plan accordingly, with comments submitted by the council.

     (e)  For purposes of this section:

     "Continuum of services" means a continuum of mental health and substance abuse services that includes prevention, intervention treatment, rehabilitation, and aftercare.

     "Council" means the state council on mental health and substance abuse.

     "Locations of service delivery" means locations where services are accessible and delivered in non-residential, residential, and hospital settings.

     "Service area" means a defined geographical area for which there is designated responsibility for the delivery of mental health and substance abuse services to persons residing, working, or attending school within the area, which areas shall be designated by the department pursuant to section 334‑3(c)(2)."

     SECTION 2.  The department shall submit a draft of the four-year state plan to the legislature no later than twenty days prior to the convening of the regular session of 2011.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
