A BILL FOR AN ACT

relating to education.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The legislature finds that the Keakealani outdoor education center is a facility located in Volcano, Hawaii, that provides important environmental education programs for the department of education.  In light of budget cuts affecting various programs and services, especially education, it is important to find ways to ensure the continued use of existing resources and the continued operation of valuable educational programs.  The legislature also finds that charter schools have a persistent need to secure facilities for classroom instruction, and that use of the Keakealani outdoor education center facilities would be beneficial to the Volcano school of arts and sciences, a public charter school located less than one mile away.

     The purpose of this Act is to transfer the land and facilities thereon controlled and used by the department of education for the operation of the Keakealani outdoor education center to the Volcano school of arts and sciences.

     SECTION 2.  Upon the effective date of this Act, all land and facilities thereon that is controlled and used by the department of education for the operation of the Keakealani outdoor education center shall be transferred to the Volcano school of arts and sciences.

     SECTION 3.  All deeds, leases, contracts, loans, agreements, permits, or other documents executed or entered into by or on behalf of the department of education relating to the operation of the Keakealani outdoor education center shall be transferred to the Volcano school of arts and sciences and shall remain in full force and effect.  Upon the effective date of this Act, every reference to the department of education or the superintendent of education in any document relating to the Keakealani outdoor education center shall be construed as a reference to the Volcano school of arts and sciences.

     SECTION 4.  This Act shall take effect upon its approval.
