A BILL FOR AN ACT

 

 

RELATING TO PRESCRIPTION DRUGS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established the medication therapy management task force within the department of health for administrative purposes and consisting of the following members:

     (1)  The director of health;

     (2)  At least one member of the board of pharmacy;

     (3)  The dean of the University of Hawaii John A. Burns school of medicine or the dean's designee; and

     (4)  The dean of the University of Hawaii at Hilo college of pharmacy or the dean's designee.

The director of health shall appoint the task force members by August 1, 2010, and also request that individuals from the following groups participate as members of the task force:

     (1)  One pharmacist each from Walgreens and Long's Drugs and representatives from two independent pharmacies; and

     (2)  A member of the Hawaii Medical Association.

     The task force shall elect from among its members a chairperson and any other officers it deems necessary.  Members of the task force shall not be compensated.

     A majority of the members of the task force shall constitute a quorum of the task force.  A quorum shall be required to approve standards, policies, and procedures developed by the task force pursuant to this Act.

     The task force shall convene its initial meeting no later than twenty days after the director of health has appointed all of the members of the taskforce.

     (b) The task force shall:

     (1)  Study medication therapy management programs implemented in other states that authorize pharmacists through a collaborative pharmacy practice agreement to provide medication therapy management;

     (2)  Develop standards, policies, and procedures to enable each pharmacy in the state that provides pharmacy services to qualified QUEST patients to maintain the capacity to offer medication therapy management services;

     (3)  Make recommendations on what the scope of medication therapy management should cover; and

     (4)  Develop standards, policies, and procedures for ensuring accurate record keeping and administration of a medication therapy management program to address issues such as patients using multiple pharmacies.

For the purposes of this subsection, "medication therapy management" means the treatment of disease or disorder through the use of prescription or non-prescription medications.

     (c)  The task force, through the department of health, shall submit to the legislature, its findings and recommendations, including any proposed legislation, no later than twenty days prior to the convening of the 2011 regular session.

     (d)  The task force shall cease to exist on June 30, 2011.

     SECTION 2.  This Act shall take effect on July 1, 2055.
