A BILL FOR AN ACT

 

 

RELATING TO HISTORIC PRESERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 6E-5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§6E-5[]]  State historic preservation officer.  (a)  The [governor shall appoint a] state historic preservation officer[, and may appoint the officer] shall be appointed by the governor from a list of not less than three nominees submitted by the board of land and natural resources and may be appointed without regard to chapter 76[, who].  In developing the list of nominees, the board shall consult with appropriate Native Hawaiian and historic preservation organizations.

     (b)  Nominees for state historic preservation officer shall meet the United States Secretary of the Interior standards for historic preservation professionals in history, archaeology, architecture, architectural history or a closely related field such as Hawaiian studies, cultural resources management, planning, environmental studies, or historic preservation, or a closely related field.

     (c)  Desirable qualifications for nominees for state historic preservation officer include the following:

     (1)  Working knowledge of the National Historic Preservation Act of 1966, as amended, and other federal laws, regulations, and executive orders that govern historic preservation matters;

     (2)  Broad knowledge of the national and state historic preservation program and the roles of the federal, state, and local governments, private organizations, and the public;

     (3)  Knowledge of various federal agency policies, procedures, and regulations, and programs, and experience in resolving conflicts between historic preservation requirements and other agency needs;

     (4)  Knowledge of the cultural history, practices, and values of Native Hawaiians; and

     (5)  Experience working with Hawaiian civic or cultural organizations.

     (d)  The state historic preservation officer shall be responsible for the comprehensive historic preservation program and [who] shall be the state liaison officer for the conduct of relations with the federal government and the respective states with regard to matters of historic preservation.  The state historic preservation officer shall be [appointed on the basis of professional competence and experience in the field of historic preservation and shall be] placed in the department for the purposes of the state program."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2040.

Amends law to require that the state historic preservation officer be appointed from a list of at least three nominees submitted by the board of land and natural resources; requires that the list of nominees be developed in consultation with the appropriate Native Hawaiian and historic preservation organizations; establishes qualifications of the officer that meet those of the Secretary of Interior; effective 7/1/2040.  (SD1)
