A BILL FOR AN ACT

 

 

relating to the department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§302A‑    Minimum instructional days required.  (a)  All public schools, including charter schools, shall provide a minimum of one hundred ninety instructional days per school year to students.

     (b)  In the event that the minimum number of instructional days in a school year is not met for any reason, the school year shall be extended to provide for the missing instructional days.

     (c)  For the purposes of this section:

     "Instructional day" shall mean a day in the school year when students, faculty, and staff are present on campus and regular classroom instruction or standardized testing that is required by law occurs; provided that "instructional day" shall also include any days in the school year where field trips, mandatory off-campus instruction, curriculum-related recreation, or other curriculum-related activities occur; provided further that "instructional day" shall not include professional development days, waiver days, or any other days that students are not present in school.

     SECTION 2.  Section 302A-101, Hawaii Revised Statutes, is amended by amending the definition of "charter schools" to read as follows:

     ""Charter schools" means public schools holding charters to operate as charter schools under chapter 302B, including start-up and conversion charter schools, that have the flexibility to implement alternative frameworks with regard to curriculum, facilities management, instructional approach, length of the school day[,] or week, [or year,] and personnel management."

     SECTION 3.  Section 302B-1, Hawaii Revised Statutes, is amended by amending the definition of "charter school" to read as follows:

     ""Charter school" refers to those public schools holding charters to operate as charter schools under this chapter, including start-up and conversion charter schools, and that have the flexibility and independent authority to implement alternative frameworks with regard to curriculum, facilities management, instructional approach, virtual education, length of the school day[,] or week, [or year,] and personnel management."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2010.
