A BILL FOR AN ACT
RELATING TO CONTRACTORS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that homeowners, inspectors, and government agencies have difficulty identifying the number of licensed tradespersons performing electrical, plumbing, and elevator work on construction job sites. Further, it may be difficult to determine whether the ratio of licensed to unlicensed tradesmen performing electrical, plumbing, and elevator work on construction job sites complies with the requirements of state law.
The purpose of this Act is to provide for the identification of licensed electricians, plumbers, and elevator mechanics and the enforcement of licensing requirements on construction job sites to protect public safety and comply with state law.
SECTION 2. Section 444-9.5, Hawaii Revised Statutes, is amended to read as follows:
"§444-9.5 Licensing [of];
electrical or plumbing workers[.]; elevator mechanics. (a)
At least half of all individuals performing electrical [or],
plumbing, or elevator mechanic work employed on a construction job site
by an electrical [or], plumbing, or elevator contractor
shall be licensed in accordance with chapter 448E[.] for electrical
or plumbing work or 448H for elevator mechanic work. The board may waive
this requirement in any county when there are insufficient licensed electrical [or],
plumbing, or elevator mechanic workers in that county to comply [herewith.]
with this section.
(b) All individuals licensed in accordance with chapter 448E or 448H, and who are employed on a construction job site by an electrical, plumbing, or elevator contractor, shall visibly display the license issued to them by the department on their person while on the construction job site. Licensed individuals not wearing their license at the time of a site inspection shall not be counted as a licensee to determine compliance with this section."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
