A BILL FOR AN ACT
proposing an amendment of the hawaii constitution relating to resignation of public officers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to propose an amendment to article II, section 7, of the Constitution of the State of Hawaii to allow for public officials to become eligible to run as a candidate for another office without having to resign from their current position. The legislature finds that matters of this nature should be decided by the voters, rather than arbitrarily restricted by law.
SECTION 2. Article 2, section 7, of the Constitution of the State of Hawaii is repealed.
["RESIGNATION
FROM PUBLIC OFFICE
Section 7. Any elected public
officer shall resign from that office before being eligible as a candidate for
another public office, if the term of the office sought begins before the end
of the term of the office held. [Add Const Con 1978 and election Nov 7,
1978]"]
SECTION 3. The question to be printed on the ballot shall be as follows:
"Shall a public official, prior to the end of their current term in office, be required to resign from that office before being eligible to run as a candidate for another office?"
SECTION 4. Constitutional material to be repealed is bracketed and stricken.
SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
