HOUSE CONCURRENT
RESOLUTION
urging the department of land and natural resources with the assistance of the department of transportation to acquire the boatyard adjacent to the state pier and to address permitting and use conflicts, at hanalei, Kauai.
WHEREAS, in the past 20 years the number of commercial and recreational ocean users in Hanalei Bay, Kauai, has increased resulting in countless conflicts among those users in the area; and
WHEREAS, the longstanding controversy over commercial boating operations on Kauai's north shore has been a burden on both the residents of Hanalei and businesses operating in Hanalei Bay; and
WHEREAS, state facilities for commercial boat operations at Hanalei Bay include a pier and offshore moorage; and
WHEREAS, county facilities for commercial boat operations include a boat launch ramp; and
WHEREAS, adjacent to the pier and boat ramp launch lies a privately-owned boatyard also used by commercial boat operators in conjunction with state facilities; and
WHEREAS, the overlapping and conflicting jurisdictions of the county special management area provisions and the state's ocean recreation rules, as well as the diverse ownership of the facilities and boatyard create a complex regulatory setting for users to navigate; and
WHEREAS, as a result of this complexity, many
unpermitted activities continue to operate in Hanalei Bay, even as many
permitted activities have ceased to operate; now, therefore;
BE IT RESOLVED by the House of Representatives of the Twenty-fifth
Legislature of the State of Hawaii, Regular Session of 2010, the Senate
concurring, that the Department of Land and Natural Resources (DLNR) with the assistance
of the Department of Transportation (DOT), is urged to acquire, by lease or
land exchange, the boatyard adjacent to its existing facilities at Hanalei Bay,
Kauai; and
BE IT FURTHER RESOLVED that DLNR with the assistance of the DOT, is urged to operate the boatyard in conjunction with existing state facilities to allow commercial and recreational boating activities; and
BE IT FURTHER RESOLVED that DLNR with the assistance of the DOT, is urged to resolve the commercial permitting problems and to address the user conflict issues for Hanalei Bay; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources and Director of Transportation.
