A BILL FOR AN ACT

RELATING TO THE UNIVERSITY OF HAWAII.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Section 103D-701, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

     "(f)  In the event of a timely protest under subsection (a), no further action shall be taken on the solicitation or the award of the contract until the chief procurement officer makes a written determination that the award of the contract without delay is necessary to protect substantial interests of the State[.]; provided that this subsection shall not apply to the University of Hawaii or the board of regents of the University of Hawaii."

     SECTION 2.  Section 103D-709, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

     "(e)  No action shall be taken on a solicitation or an award of a contract while a proceeding is pending, if the procurement was previously stayed under section 103D-701(f)[.]; provided that this subsection shall not apply to the University of Hawaii or the board of regents of the University of Hawaii."

     SECTION 3.  Section 103D-709, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:

     "(g)  No action shall be taken on a solicitation or an award of a contract while a proceeding is pending, if the procurement was previously stayed under section 103D-701(f)[.]; provided that this subsection shall not apply to the University of Hawaii or the board of regents of the University of Hawaii."

     SECTION 4.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2050; provided that:

     (1)  Section 3 shall be repealed and section 2 shall take effect on July 1, 2011, upon the reenactment of section 103D-709, Hawaii Revised Statutes, pursuant to section 14(2) of Act 175, Session Laws of Hawaii 2009; and

     (2)  This Act shall be repealed on July 1, 2012; provided that:

         (A)  Section 103D-701(f), Hawaii Revised Statutes, shall be reenacted in the form in which it read prior to the effective date of this Act; and

         (B)  Section 103D-709, Hawaii Revised Statutes, as amended by section 2 of this Act, shall be reenacted in the form in which it read prior to the effective date of Act 175, Session Laws of Hawaii 2009.
