A BILL FOR AN ACT

 

 

relating to cable television.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to require a portion of the cable television annual fee to be deposited into the general fund.

     SECTION 2.  Section 440G-15, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Each cable operator shall pay an annual fee to be determined by the director.  The fees so collected under this section shall be deposited into the compliance resolution fund established under section 26-9(o)[.]; provided that notwithstanding any law to the contrary, from July 1, 2010, to June 30, 2015:

     (1)  The fees shall be used to offset the costs of administering this chapter; and

     (2)  One-half of the fees in excess of the amount designated for administrative expenses shall be deposited into the general fund."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon approval.
