A BILL FOR AN ACT

 

 

RELATING TO STATE LEASES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§141- _  State leases; temporary structures.  Notwithstanding any other law to the contrary, the erection or use of a temporary structure by an agricultural or aquacultural lessee on state leased land shall not require state or county approval, or a county building permit; provided that:

     (1)  The structure is a recycled ocean shipping container, modular structure, agricultural cold frame, storage shed, or other structure built in compliance with the International Council of Building Official's uniform building code; and

     (2)  The lessee signs a waiver releasing the state and applicable county from general liability with respect to the use of the temporary structure.

     "Temporary structure" means a structure that does not rest on any concrete, stone, or metal foundation, footing, or pier."

     SECTION 2.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§171-    State leases; temporary structures.  Notwithstanding any other law to the contrary, the erection or use of a temporary structure by an agricultural or aquacultural lessee on state leased land shall not require state or county approval, or a county building permit; provided that:

     "§201-    State leases; temporary structures.  Notwithstanding any other law to the contrary, the erection or use of a temporary structure by an agricultural or aquacultural lessee on state leased land shall not require state or county approval, or a county building permit; provided that:

     (1)  The structure is a recycled ocean shipping container, modular structure, agricultural cold frame, storage shed, or other temporary structure built in compliance with the International Council of Building Official's uniform building code; and

     (2)  The lessee signs a waiver releasing the state and applicable county from general liability with respect to the use of the temporary structure.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
