A BILL FOR AN ACT
RELATING TO INTOXICATING LIQUOR.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 281-44, Hawaii Revised Statutes, is amended by amending its title and subsection (a) to read as follows:
"§281-44 Advertisements and signs upon
licensed premises[.]; driving under the influence;
fetal alcohol syndrome. (a) All licensed premises shall post [a
sign] signs in or about the premises containing and notifying all
customers and other persons of [the]:
(1) The possible sanctions that may be
imposed for operating a vehicle under the influence of an intoxicant under
sections 291E-41 and 291E-61[.]; and
(2) The dangers of fetal alcohol syndrome; provided that:
(A) The sign shall be no larger than eight and one-half inches by eleven inches with the message: "GOVERNMENT WARNING: ACCORDING TO THE SURGEON GENERAL, WOMEN SHOULD NOT DRINK ALCOHOLIC BEVERAGES DURING PREGNANCY BECAUSE OF THE RISK OF BIRTH DEFECTS; and
(B) The sign shall be provided to licensees by the liquor commission; provided that the liquor commission shall be reimbursed for all costs by the State related to the preparation of the sign.
The [sign] signs shall be
conspicuously positioned in order to be seen by an ordinarily observant person."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof as may be necessary for fiscal year 2010-2011 for the purposes of this Act.
The sums appropriated shall be expended by the department of budget and finance for the purposes of this Act.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2009.
