A BILL FOR AN ACT
relating to internet caller identification.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 708, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§708- Deceptive internet caller identification. (1) A person commits the offense of deceptive internet caller identification if the person, other than a recipient of a call, knowingly uses any internet caller identification equipment or internet telephone equipment in such a manner as to make a number or name, other than the residential or business telephone number or a legal or business name of the subscriber or registered user of the internet telephone service, appear on a caller identification system of the recipient of the call.
(2) This section shall not apply to service providers that transmit caller identification information created or supplied by others.
(3) For the purposes of this section, "caller identification" means the display of the caller's telephone number or identity to the recipient of the call.
(4) Deceptive internet caller identification is a misdemeanor."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
