A BILL FOR AN ACT
relating to historic preservation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§6E- Archaeological permit special account. (a) There shall be a special account within the Hawaii historic preservation special fund to be known as the "archaeological permit special account".
(b) Moneys deposited into the special account shall first be used to cover the administrative and operational costs of managing the archaeological permit system.
(c) Moneys remaining after disbursement under subsection (b) shall be expended as provided in section 6E-16(b).
(d) The department shall adopt rules in accordance with chapter 91 for the purposes of this section."
SECTION 2. The board of land and natural resources is directed to amend any appropriate administrative rules, to increase archaeological permit fees from the current rate of $50 to no less than $1,000, and to specify that the permit fees are to be deposited into the archaeological permit special account established under section 6E- , Hawaii Revised Statutes.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2010.
