A BILL FOR AN ACT
relating to statewide traffic code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 291C-102, Hawaii Revised Statutes, is amended to read as follows:
"§291C-102 Noncompliance with speed limit prohibited. (a) A person violates this section if the person drives:
(1) A motor vehicle at a speed greater than the maximum speed limit other than provided in section 291C‑105; or
(2) A motor vehicle at a speed less than the minimum speed limit,
where the maximum or minimum speed limit is established by county ordinance or by official signs placed by the director of transportation on highways under the director's jurisdiction.
(b) Violators of this section shall be assessed a surcharge of $25, of which $15 shall be deposited into the general fund and $10 shall be paid to the director of finance of the county in which the violation occurred; provided that the state director of finance shall deduct and retain an additional amount equal to ten percent of the counties' share as an administrative fee to be deposited into the general fund.
[(b)] (c) If the maximum speed
limit is exceeded by more than ten miles per hour, a surcharge of $10 shall be
imposed, in addition to any other penalties, and shall be deposited into the
neurotrauma special fund."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
