A BILL FOR AN ACT
relating to Environmental protection.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342J- Facility placement; prohibition in inundation area. After the effective date of this Act, no facility for the storage of hazardous waste, fuel, used oil, used fuel oil, or any other substance regulated by this chapter shall be located, constructed, or operated within an anticipated inundation area designated on the department of defense's civil defense tsunami inundation maps."
SECTION 2. Chapter 342L, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342J- Placement; prohibition in inundation area. After the effective date of this Act, no underground storage tank or underground storage tank system shall be located, constructed, or operated within an anticipated inundation area designated on the department of defense's civil defense tsunami inundation maps."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2009.
