The purpose of this hearing is to receive testimony on the renewable energy producer provisions of section 171-95, Hawaii Revised Statutes (HRS) (originally enacted as Act 102, Session Laws of Hawaii, 2002) and the subsequent action taken by the Board of Land & Natural Resources at their meeting held on Friday, November 14, 2008 in the Kalanimoku Building in Honolulu. A probable outcome of the hearing may be proposing amendments to section 171-95, HRS, to allow other alternative energy entities to participate in the process prior to selection, to provide better public notification of pending applications, and to hold the decision-making meeting on the island where the project is proposed to occur.

DECISION MAKING WILL NOT OCCUR AT THIS HEARING. Should the Committee decide to take action on proposed amendments to the renewable energy producer provisions of section 171-95, HRS, additional hearing(s) will be scheduled during the 2009 legislative session to receive testimony on legislation introduced for this purpose.

Persons wishing to testify should submit testimony in one of the following ways at least 24 hours prior to the hearing:
· In Person: 1 copy of their testimony to the Committee Clerk, Room 228, State Capitol.
· By FAX: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
· By E-mail: Testimony may be emailed if less than 5 pages in length, to WTLTestimony@capitol.hawaii.gov
E-mail sent to individual offices or any other Senate office will not be accepted.
LATE TESTIMONY – Testimony received after the testimony deadline will be posted on the legislature's website after the hearing ends. If you are testifying in person, please bring twelve (12) copies of your testimony to the hearing room and submit it to the committee clerk PRIOR to the start of the hearing.
