RELATING TO MOTOR VEHICLE INSURANCE RATE FILINGS. Requires insurers to file rates that provide for an appropriate reduction in premium charges for insureds who are 65 years of age and older after successfully completing a motor vehicle accident prevention course. Requires the department of transportation to develop the criteria for the motor vehicle accident prevention course. Establishes that the instructor-led or online version of the National Safety Council Defensive Driving Course are deemed to meet the department's criteria.

RELATING TO ARMED SERVICES. Provides an exemption from vehicle taxes and registration fees for members of the armed services, including members of the National Guard and Reserves, who were disabled in the line of duty while on active military service.

RELATING TO VEHICLE AUDIO EQUIPMENT. Prohibits aftermarket car audio equipment with the potential to produce nuisance volume levels. Establishes fine for violation.

RELATING TO VEHICLES. Limits the purchase and rebuilding of salvaged vehicles to licensed individuals. Includes airbags as a resale component that requires department of transportation approval.

RELATING TO HIGHWAY SAFETY. Establishes the photo red light imaging detector system program. Authorizes counties to implement the program. Increases the time to mail a citation to the owner of the vehicle that used a high occupancy lane illegally.

RELATING TO EDUCATION. Requires the director of transportation to conduct a statewide pupil travel evaluation to study how students get to school and to use that information to award federal grants for school-based workshops and community planning that will reduce traffic congestion, encourage walking and bicycling, and increase health and safety. Requires the director of transportation to streamline the grant application process. Requires annual reports

RELATING TO SCHOOL BUSES. Requires public and private elementary school children to wear seat belts on school buses. Requires all state contracted school buses to be fitted with seat belts after July 1, 2010.

RELATING TO CIVIL ACTIONS. Clarifies that government entities are only liable in certain cases for the percentage share of the damages they actually caused.

RELATING TO TRAFFIC COURT RECORDS. Permits online requests of traffic abstracts and traffic court reports. Authorizes judiciary to impose a fee and require verification of identity before releasing reports.

RELATING TO ADMINISTRATIVE REVOCATION. Authorizes administrative director of the courts to permit administrative driver's license revocation hearings to be held in county other than county of arrest and to permit hearings by telephonic, video, or other electronic means.

RELATING TO MASS TRANSIT ROUTE ECONOMIC ZONES. Creates a task force to recommend parameters for the creation of mass transit route economic zones including eligibility and benefits and incentives such as tax credits. Report to legislature, including process to designate economic zones and incentives to attract businesses and affordable housing to encourage ridership. Task force terminates on 06/30/10.

RELATING TO TAXATION. Specifies that a county shall not grant an exemption from the general excise tax (GET) or receipt taxes for a mixed-use transit-oriented joint development project. Exempts from GET a project developed to provide affordable rental housing or a community health care facility within a mixed-use transit-oriented joint development project.

RELATING TO HIGHWAY SAFETY. Makes amendments to Act 171, Session Laws of Hawaii 2008, reflecting recommendations of Ignition Interlock Implementation Task Force.

RELATING TO HAWAII AIR CARRIERS. Amends chapter 261E, HRS, related to the regulation of Hawaii interisland air carriers; expands the application of chapter language; deletes issuance of securities and adds capacity discussions.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
