RELATING TO THE COMPREHENSIVE OFFENDER REENTRY SYSTEM. Clarifies various provisions of the comprehensive offender reentry system; mandates written reentry plans; limits the maximum number of Hawaii inmates housed in out‑of‑state prisons to 2,000 by 12/31/2010; establishes a reentry commission; sunsets the legislative oversight committee on July 1, 2009. (SD2)

RELATING TO PUBLIC SAFETY. Authorizes judiciary fees on parolee and probationer's prison transfer applications to be deposited into the probation services special fund. Authorizes a full‑time coordinator position for the state council for interstate adult offender supervision to be paid from the probation services special fund. Limits expenditures from the probation services special fund to $400,000 every fiscal year. Effective date 07/01/50. (SD1)

RELATING TO PUBLIC SAFETY. Requires privately owned prisons or out-of-state detention facilities holding prisoners under a contract with the State to follow state freedom of information laws pursuant to chapter 92F, Hawaii Revised Statutes. (SD2)

RELATING TO VOTING. Allows incarcerated persons who were Hawaii residents at the time of their arrest and who have no more than two years left before release from imprisonment, to vote by absentee ballot in Hawaii's elections. Effective 7/1/2050 (SD2)

RELATING TO PUBLIC SAFETY. Establishes a task force within the office of Hawaiian affairs to study the disparate treatment of native Hawaiians and other ethnic groups in the State's criminal justice system. (SD2)

RELATING TO CONTROLLED SUBSTANCES. Makes Hawaii's controlled substance laws consistent with that of federal law and clarifies sections of chapter 329 relating to controlled substances. Effective 7/1/2050. (SD2)

RELATING TO STATE DISASTER RELIEF. Clarifies that the governor has the authority to declare a disaster emergency. Requires the state civil defense division after the governor has proclaimed a disaster emergency, to report to the governor, legislature, and each county mayor on the disaster, including specified information. RELATING TO DISASTER RELIEF. Activates provisions of the State's disaster relief law to apply to emergencies, except for enemy attack. Clarifies the use of the governor's emergency powers in response to a natural or manmade disaster. Limits the governor's powers to provide disaster relief or the length of time that the governor may provide disaster relief in specific circumstances without legislative authorization. States that, in certain cases, emergency powers in force prior to the effective date of this measure expire at the end of the 2009 regular session unless reauthorized by the legislature. (SD2)

RELATING TO CIVIL DEFENSE. Supports State Civil Defense's Shelter-in-Place initiative by exempting civil liability for care homes and schools, in addition to hotels, during an officially designated emergency. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
