Establishes a ten-year statute of limitations on tax collections.  Clarifies that the three-year statute of limitations on tax assessments for the general excise tax, use tax, and other period taxes begins running from the filing of each periodic return

RELATING TO TAXATION.

Requires a tax refund to be deposited in the taxpayer's accounts; prohibits deposit into a paid preparer's accounts; requires a paid preparer to sign a return; establishes penalties.

Provides that if evidence of an alleged victim's character for aggressiveness is offered by an accused and admitted under paragraph (2), evidence of the same trait of character of the accused offered by the prosecution may be admissible.

RELATING TO GAMBLING.

Amends definition of gambling to clarify that purchase of sweepstakes entry that also provides nominal non-gambling value constitutes gambling even if sweepstakes entry can be obtained without payment of consideration.  Eliminates free play as a defense under certain circumstances.

Authorizes the speaker of the house of representatives or the president of the senate, separately as well as jointly, to employ or retain attorneys.

Amends section 338-4, Hawaii Revised Statutes, to redefine data reportable to county clerks in a manner consistent with protecting social security numbers.

·         In person:  1 copy of their testimony to the committee clerk, Room 016, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 4:30 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
