RELATING TO THE CIVIL RIGHTS COMMISSION. Adds a definition for confidential witness to section 368‑4, HRS, to distinguish confidential witness statements and statements of the parties to a complaint filed with the civil rights commission.

RELATING TO PROTECTIVE PROCEEDINGS. Modifies requirements related to the basis for court appointment of a conservator.

RELATING TO PERSONAL LIABILITY OF TRUSTEE TO THIRD PARTIES. Amends Hawaii Probate Code provisions on personal liability of a trustee for consistency with Uniform Probate Code.

RELATING TO ADMINISTRATIVE REVOCATION. Authorizes administrative director of the courts to permit administrative driver's license revocation hearings to be held in county other than county of arrest and to permit hearings by telephonic, video, or other electronic means.

RELATING TO FAMILY COURT. Increases the maximum term of a temporary guardianship of a minor from six months to twelve months.

RELATING TO THE PENAL CODE. Establishes the payment priority of the DNA analysis fee over other fees and fines assessed against a defendant by the court.

RELATING TO DISTRICT COURT. Expands jurisdiction of small claims division of the district court.

RELATING TO COURT ADVISEMENT OF ALIENS. Clarifies the requirement that courts advise pleading defendants of the possible consequences of the plea upon alien status.

RELATING TO POST CONVICTION PROCEEDINGS. Establishes a time limitation for filing habeas corpus complaints and post-conviction judicial proceedings. Limits successive complaints.

RELATING TO METAL. Removes sunset clause in Act 197, Session Laws of Hawaii 2007, which contains a repeal date of July 1, 2009.

· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
· By Web: Testimony may be submitted online if less than 4MB in size, at http://www.capitol.hawaii.gov/emailtestimony.
· By Email: Testimony may be emailed if less than 5 pages in length, to the Committee at JGOTestimony@Capitol.hawaii.gov . Please indicate the measure, date and time of the hearing. Email sent to individual offices or any other Senate office will not be accepted.
Please note: If you submit your written testimony after 4:30 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
