MAKING AN APPROPRIATION FOR THE STATE COMMISSION ON FATHERHOOD. Appropriates funds for the state commission on fatherhood.

RELATING TO CHILDREN. Establishes a pilot project to develop and operate statewide emergency care, hanai ohana care, and specialized learning facilities for endangered and disadvantaged children. Requires the State to lease land at a reduced rate to the department of human services for these purposes.

RELATING TO THE PENAL CODE. To provide greater protections to victims of domestic violence who the court is already attempting to keep safe through protective orders.

RELATING TO CHILD ABUSE. To provide greater protection to our children, this bill amends the offense of promoting child abuse in the second degree to include the possession of particularly violent or egregious child pornography, and it adds mandatory sentencing provisions for serious child abuse offenses.

RELATING TO CHILD SUPPORT ENFORCEMENT. Clarifies that all income withholding payments be sent through the Child Support Enforcement Agency; allows the agency to disburse support by electronic deposit or debit card; allows for electronic copy or facsimile of a signature as proof of service for certified mail; clarifies lien payment and enforcement.

RELATING TO PERMANENCY HEARINGS. Amends chapter 587, Hawaii Revised Statutes, to ensure compliance with federal Title IV-E hearing requirements.

RELATING TO NOTICE OF GUARDIANSHIP PROCEEDINGS. Amends section 560:5-113, Hawaii Revised Statutes, to provide that notice to parents shall not be required if the parents have been served in a proceeding under chapter 587, Hawaii Revised Statutes, and a permanent plan has been ordered by the Court.

RELATING TO PUBLIC ASSISTANCE. Amends section 346-1, Hawaii Revised Statutes, by adding definitions of "work eligible household" and "other work eligible household" and repealing the definition of "exempt household" to be consistent with recent changes in federal regulations. Also amends section 346-53(a), Hawaii Revised Statutes, to be consistent with the new definitions.

RELATING TO ASSISTANCE FOR AGED, BLIND, AND PERMANENTLY AND TOTALLY DISABLED PERSONS. Indicates that assistance for eligible aged, blind, and permanently and totally disabled persons is available up to the amount of any legislative appropriation not to exceed the current statutory sixty-two and one-half per cent of the standard of need.

RELATING TO GENERAL ASSISTANCE. Places a twelve-month limit on general assistance to households without minor dependents with appropriate exceptions.

RELATING TO MEDICAID LIENS. Clarifies existing law so the notice of the intent to place a lien on the real property of a Medicaid recipient will be valid if provided to the recipient or a designated representative of the recipient.

RELATING TO FEDERAL FINANCIAL ASSISTANCE FOR INDEPENDENT LIVING SERVICES AND CENTERS. Repeals section 348-9, Hawaii Revised Statutes, that establishes the Statewide Council on Independent Living.

RELATING TO CHILD WELFARE SERVICES. Adds definitions of "caregiver" and "safe home" to the Child Protective Act. Clarifies that local customs of caring for children outside the family home by relatives and friends are, where appropriate, available alternatives to the department of human services and the court assuming custody of children.

MAKING AN APPROPRIATION FOR SAFE HAVEN AFTER SCHOOL PROGRAM. Appropriates funds as a grant-in-aid to Hawaii county for the safe haven after school program.

MAKING AN APPROPRIATION FOR BIG ISLAND JUVENILE INTAKE AND ASSESSMENT CENTER. Appropriates funds as a grant-in-aid to the county of Hawaii for the juvenile intake and assessment center pilot site in Pahoa, Hawaii.

RELATING TO PRENATAL EXPOSURE TO CONTROLLED SUBSTANCES. Requires specified persons to report possible non-medical drug or alcohol abuse by a pregnant woman to the department of human services. Allows voluntary reporting by anyone else. Requires department of human services to make an assessment and offer services to the pregnant woman.

RELATING TO DRUG TESTING. Requires recipients of general assistance, food stamps, and temporary assistance to submit to drug testing for reasonable cause.

RELATING TO PUBLIC PROCUREMENT. Establishes a preference for bidders to government contracts who pledge to hire individuals with disabilities and certain temporary assistance to needy families recipients.

RELATING TO EARLY LEARNING. Authorizes the Hawaii Council of Mayors to name designees for their two representatives on the early learning council; changes the name of the keiki first steps trust fund to the early learning council trust fund and specifies that moneys in the trust fund shall not lapse at the end of the fiscal year.

RELATING TO GENERAL ASSISTANCE. Protects recipients of general assistance from having their benefits reduced by more than 10%. Requires DHS to allow individuals to receive general assistance benefits for the maximum amount of time permissible under federal law.

RELATING TO UTILITIES. Requires the public utilities commission to implement a program to achieve lifeline electricity rates for residential electricity users who are elders with limited income, the handicapped with limited income, and any person with a medical condition who is dependent on a medical device requiring electricity to operate.

MAKING AN EMERGENCY APPROPRIATION FOR THE DEPARTMENT OF HUMAN SERVICES TO ADDRESS THE BUDGET SHORTFALL. Emergency appropriation from the Emergency and Budget Reserve Fund to replace general funds appropriated for the health care payments program (HMS 401) to address the budget shortfall in fiscal year 2008-2009.
