RELATING TO INSURANCE. Amends Act 177, Session Laws of Hawaii 2008 (Life Settlements Model Act) by repealing the requirement that the insurance commissioner report annually to the legislature on the implementation and effects of Act 177 and by making the Act permanent.

RELATING TO THE RIGHTS OF VICTIMS. Amends the crime victims' bill of rights to include notice or waiver of notice as to an offender's unfitness to stand trial, transfer to the state hospital or other psychiatric facility, or regaining fitness to proceed. Requires the department of health to provide notice of offender unauthorized absences. (SD1)

RELATING TO HEALTH. Lowers the minimum age requirement for blood donation to sixteen years old with parental consent.

RELATING TO VOLUNTEER MEDICAL ASSISTANCE SERVICES. Provides for medical expenses and immunity from liability for licensed medical personnel providing volunteer medical services on behalf of the State or a county.

RELATING TO DEPARTMENT OF HEALTH CERTIFICATES. Repeals the requirement for a sanitation certificate to be issued for county business licenses for the operation of a lodging or tenement house, group home, group residence, group living arrangement, hotel, or boarding house. The City and County of Honolulu no longer requires business licenses for these facilities because of Act 35, Session Laws of Hawaii 2001, so the sanitation certificate is unnecessary for Oahu. The counties of Kauai, Maui, and Hawaii never required a sanitation certificate for these types of businesses.

RELATING TO MENTAL HEALTH. Clarifies that the provisions of section 704-412, Hawaii Revised Statutes, govern the timing and standards of decision for applications for conditional release or discharge from the custody of the Director of Health and includes a time frame for decisions on motions for conditional release or discharge.

RELATING TO PHYSICIAN ASSISTANTS. Authorizes physician assistants to sign certain documents; to provide emergency medical care without supervision; to administer immunizations; to prescribe medications for patients suffering from human immunodeficiency virus or acquired immune deficiency syndrome without preauthorization; limits liability of physician assistants under good Samaritan laws. RELATING TO COMPREHENSIVE SEXUALITY HEALTH EDUCATION. Requires any recipient of state funding to provide medically accurate sexuality education. (SD1)

RELATING TO DENTISTS. Authorizes the board of dental examiners to sanction licensees for false or misleading advertising.

RELATING TO DENTISTRY. Amends dental licensing laws so that a dentist enrolled in an American Dental Association Commission on Dental Accreditation accredited dental residency program can be granted a temporary license for the duration of the program.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:

FAX: For comments less than 5 pages in length, transmit to 586-8519 (Oahu) or 1-800-535-3859 (Neighbor Islands); or
EMAIL: For comments less than 5 pages in length, transmit to HLTtestimony@Capitol.hawaii.gov.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
