RELATING TO TELEWORK. Establishes the telework task force to develop a comprehensive plan that will encourage and expand telework opportunities in Hawaii while reducing harmful environmental impacts, traffic congestion, the dependence on fossil fuels, and encourage a better quality of life for people who commute to work in Hawaii. Makes an appropriation.

RELATING TO MASS TRANSIT ROUTE ECONOMIC ZONES. Creates a task force to recommend parameters for the creation of mass transit route economic zones including eligibility and benefits and incentives such as tax credits. Report to legislature, including process to designate economic zones and incentives to attract businesses and affordable housing to encourage ridership. Task force terminates on 06/30/10.

RELATING TO ESTABLISHING A COUNTY TRANSIT ORIENTED DEVELOPMENT INFRASTRUCTURE REVOLVING FUND. Creates the county infrastructure development revolving loan fund within department of budget and finance to provide no-interest loans to the counties for the development, pre-development, or construction of infrastructure projects to expedite the building of transit-oriented development, especially those involving affordable housing. Effective 07/01/2050.

RELATING TO TRANSPORTATION. Allows the State to enter into agreements with private entities to build, operate, own, or finance newly constructed transportation facilities including toll highways.

RELATING TO HIGHWAYS. Authorize the department of transportation to pursue a comprehensive 6-year modernization program and providing it sufficient resources to implement the plan by amending the state liquid fuel tax, state vehicle registration fee, state vehicle weight fee, and rental motor vehicle surcharge through increases of the various taxes and the flat rate amount in sections 243-4(a), 249-31, 249-33(a), and 251-2(a), Hawaii Revised Statutes. Authorize the implementation of a Vehicle Miles Traveled Pilot Program. Effective 07/01/2011.

RELATING TO CIVIL ACTIONS. Clarifies that government entities are only liable in certain cases for the percentage share of the damages they actually caused.

RELATING TO HARBORS. Authorizes the Director of Transportation to require any person who uses or occupies State commercial harbors for business or commercial purposes, to defend, indemnify, and hold harmless the State against claims that may arise from such use or occupation.

RELATING TO AIRPORTS. Allows the Director of Transportation to adopt rules to require users or occupiers of airport land, buildings, or facilities for business or commercial purposes to defend, indemnify, and hold harmless the State against all claims, suits, and demands arising out of or resulting from the use or occupation. Also allows the Director to adopt rules relating to the designation of airport operational areas.

RELATING TO AIRPORT CONCESSIONS. Allows for certain adjustments and modifications to airport concession leases. Effective 07/01/2050.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
