RELATING TO TAXATION. Extends the availability of the high technology business investment, research activities, and technology infrastructure renovation tax credits. Beginning January 1, 2010, caps aggregate high tech business investment credits for a year to $50,000,000. Caps aggregate high tech business investment credits in a year for investments in a single qualified high tech business to $10,000,000. Strengthens administrative oversight of tax credits. RELATING TO TAXATION. Requires the Department of Taxation to evaluate certain tax credits and tax exemptions and report to legislature. Provides automatic repeal of the tax credits and tax exemptions. Provides a penalty for excessive amounts filed for tax refunds and credits. (HB611 HD1)

RELATING TO THE GENERAL EXCISE TAX. Amends the definition of engaging in business under section 237-2, HRS (general excise tax), to include persons who enter into an agreement with residents of the State where the person pays a commission for referral of potential customers. (HB1405 HD2)

RELATING TO BUILDINGS. Repeals the amendments made by Act 228, Session Laws of Hawaii 2008, which require the taking of photographs of actual or potential historic buildings before demolition, construction, or alteration of the buildings. (HB520 HD1)

RELATING TO LIMITED LIABILITY COMPANIES. Creates an optional "public purpose company" designation for LLCs. Requires an LLC with a public purpose company designation to exercise its right to exclude conferred by any patent it has an interest in for a public purpose. Establishes reporting requirements. · By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
