RELATING TO REAL ESTATE BROKERS AND SALESPERSONS. Specifies that acting as a real estate broker and salesperson pursuant to a real estate license does not constitute the practice of law.

RELATING TO ATTORNEYS' FEES. Clarifies that Hawaii law relating to the recovery of attorneys' fees in actions in the nature of assumpsit does not apply to common law tort, breach of fiduciary duty, and statutory causes of actions brought by a condominium unit owner against an association.

RELATING TO THE FUNERAL INDUSTRY. Establishes a board of cemetery and funeral trusts. Establishes a pre-need cemetery and funeral governance fund. Prohibits additional practices. Authorizes the director of commerce and consumer affairs to prohibit a pre-need authority from engaging in sales and withdrawals for failure to submit required audits.

RELATING TO METAL. Repeals the 07/01/09 "sunset" date in Act 53, SLH 2008, that established the misdemeanor offense of theft of beer keg and imposed recordkeeping requirements on scrap metal dealers that purchase beer kegs. Effective 06/30/09.

· By Email: Testimony may be emailed if less than 5 pages in length, to the Committee at CPNTestimony@Capitol.hawaii.gov . Please indicate the measure, date and time of the hearing. Email sent to individual offices or any other Senate office will not be accepted.
Please note: If you submit your written testimony after 4:30 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
