SENATE RESOLUTION
REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES, THE DEPARTMENT OF HAWAIIAN HOME LANDS, AND THE KAUAI POLICE DEPARTMENT TO ENTER INTO A MEMORANDUM OF UNDERSTANDING REGARDING THE ENFORCEMENT OF STATE LAWS AND COUNTY ORDINANCES AT ANAHOLA AND ALIOMANU BEACH AREA.
WHEREAS, the Anahola and Aliomanu Beach area is on the north eastern coast of the island of Kauai; and
WHEREAS, the Department of Land and Natural Resources has jurisdiction over the wet sand section of Anahola and Aliomanu Beach area; and
WHEREAS, the Department of Hawaiian Home Lands has jurisdiction over the remaining section of Anahola and Aliomanu Beach area, but has no enforcement personnel for Kauai; and
WHEREAS, the Kauai Police Department does not have the proper equipment to perform law enforcement activities on the sand portion of the Anahola and Aliomanu Beach area; and
WHEREAS, the Anahola and Aliomanu Beach area is the site of frequent nuisance activities including noisy gatherings, illegal bonfires, suspected illegal drug activity, and vehicular traffic on the beach; and
WHEREAS, the Anahola-Aliomanu Community is in close proximity to the Anahola and Aliomanu Beach area; and
WHEREAS, the residents of the Anahola-Aliomanu Community have raised their concerns over the ongoing nuisance activities at the Anahola and Aliomanu Beach area to the Department of Land and Natural Resources and the Department of Hawaiian Home Lands; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, that the Department of Land and Natural Resources, the Department of Hawaiian Home Lands, and the Kauai Police Department are requested to enter into a memorandum of understanding regarding the enforcement of state laws and county ordinances at the Anahola and Aliomanu Beach area; and
BE IT FURTHER RESOLVED that the Department of Hawaiian Home Lands is requested to submit an executed copy of the memorandum of understanding and a written report of findings and recommendations, including any necessary proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2010; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, the Chairperson of the Hawaiian Homes Commission, the Kauai County Mayor, the Chair of the Kauai County Council, and the Chief of Police for Kauai Police Department.
