SENATE CONCURRENT

RESOLUTION

 

 

SUPPORTING THE ST. FRANCIS HEALTHCARE SYSTEM OF HAWAII'S PLAN FOR THE POST-BANKRUPTCY PROCEEDINGS OF THE HAWAII MEDICAL CENTER.

 

 


     WHEREAS, the Sisters of St. Francis have served the healthcare needs of the people of Hawaii since 1883; and

 

     WHEREAS, the Sisters of St. Francis came to Hawaii in response to pleas from King Kalakaua, Queen Kapiolani, and local officials; and

 

     WHEREAS, the Sisters of St. Francis have willingly responded to community health needs by caring for the Hansen's disease patients in Kalaupapa and Kalawao and administering the branch hospitals at Kakaako, Maululani Hospital (now Maui Memorial Medical Center), Hilo County Memorial Hospital (now Hilo Medical Center), and St. Francis Medical Centers (now Hawaii Medical Center); and

 

     WHEREAS, the St. Francis Healthcare System is a lender and creditor for certain financial transactions relating to the sale of St. Francis Medical Center to the Hawaii Medical Center; and

 

     WHEREAS, the Hawaii Medical Center filed for Chapter 11 bankruptcy reorganization on August 29, 2008; and

 

     WHEREAS, the Hawaii Medical Center has not been able to meet its financial obligations to the St. Francis Healthcare System since declaring bankruptcy; and

 

     WHEREAS, this failure on the part of the Hawaii Medical Center negatively impacts St. Francis Healthcare System's ability to deliver needed special healthcare services in the State; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the House of Representatives concurring, that the Legislature supports the Chapter 11 plan submitted by the St. Francis Healthcare System of Hawaii to the United States Bankruptcy Court; and

 

     BE IT FURTHER RESOLVED that the Legislature acknowledges that the acceptance of this Chapter 11 bankruptcy plan will facilitate the continuing efforts of the Sisters of St. Francis and the St. Francis Healthcare System of Hawaii to provide quality healthcare to the people of Hawaii; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the United States Bankruptcy Court for the District of Hawaii, United States Trustee for Region 15, Chief Executive Officer of St. Francis Healthcare System of Hawaii, and the Chief Executive Officer of the Hawaii Medical Center.
