A BILL FOR AN ACT
RELATING TO DISCRIMINATION IN REAL PROPERTY TRANSACTIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to clarify the definition of "familial status" in the law pertaining to discrimination in real property transactions to specify that a person domiciled with a minor child or children must have written permission from the child's parent to qualify for "familial status".
SECTION 2. Section 515-2, Hawaii Revised Statutes, is amended by amending the definition of "familial status" to read as follows:
""Familial status" means the
status of: a parent having legal custody of and domiciled with a minor child
or children, a person who is domiciled with a minor child or children and who
has written [or unwritten] permission from the legal parent, a person
who is pregnant, or any person who is in the process of securing legal custody
of a minor child or children."
SECTION 3. Statutory material to be repealed is bracketed and stricken.
SECTION 4. This Act shall take effect upon its approval.
