A BILL FOR AN ACT
relating to capital improvements.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Act 213, Session Laws of Hawaii 2007, as amended by Act 158, Session Laws of Hawaii 2008, is amended by amending part IV, section 125, item G.91 to read as follows:
"91. WAIAKEA HIGH SCHOOL, HAWAII

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date.
SECTION 4. The sums appropriated for the respective capital projects set forth in section 1 shall be expended by the designated expending agency for the purposes of this Act; provided that:
(1) The sums appropriated in items 1 through 5 shall be expended by the county of Hawaii;
(2) The sums appropriated in items 6 through 10 shall be expended by the department of water supply, county of Hawaii;
(3) The sum appropriated in item 11 shall be expended by the department of public works, county of Hawaii;
(4) The sums appropriated in items 12 and 13 shall be expended by the department of transportation;
(5) The sum appropriated in item 14 shall be expended by the department of accounting and general services;
(6) The sum appropriated in item 15 shall be expended by the department of agriculture;
(7) The sum appropriated in item 16 shall be expended by the University of Hawaii; and
(8) The sums appropriated in items 17 through 24 shall be expended by the department of education;
SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2009.
