A BILL FOR AN ACT

 

 

RELATING TO PUBLIC EMPLOYMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Definitions.  For the purposes of this Act:

     "Employee" means a state or county employee or officer.   "Furlough" means the placement of an employee temporarily and involuntarily in a nonpay and nonduty status.

     SECTION 2.  Any furlough of an employee during fiscal years 2008-2009 through 2012-2013 shall not cause or be deemed to cause:

     (1)  A break in the employee's employment;

     (2)  A decrease in the employer's contribution to the Hawaii employer-union health benefits trust fund or voluntary employee beneficiary association trust;

     (3)  A change in the amount of vacation or sick leave earned by the employee;

     (4)  A decrease in the employee's length of service for purposes of the employee's pension, retirement, and deferred compensation plans; and

     (5)  Any change to any right, privilege, or benefit to which the employee is entitled or to which the employee would have been entitled to by law but for the furlough; provided that an employee's retirement allowances and other benefits under chapter 88, Hawaii Revised Statutes, shall be based on the employees actual compensation during the furlough.

     SECTION 3.  This Act shall take effect upon its approval.
