HOUSE RESOLUTION

REQUESTING CONGRESS to enact necessary legislation to allow qualified patients to TRANSPORT MEDICAL MARIJUANA and paraphernalia FOR PERSONAL USE when traveling interstate.

     WHEREAS, part IX of chapter 329, Hawaii Revised Statutes, permits qualifying patients to obtain written certification for the medical use of marijuana; and

     WHEREAS, such certification permits qualifying patients to acquire, possess, cultivate, use, distribute, or transport marijuana for personal use to alleviate symptoms or effects of debilitating medical conditions; and

     WHEREAS, Hawaii's qualifying patients who wish to travel to destinations within the United States are typically required to travel by air; and

     WHEREAS, qualifying patients traveling by air must be screened by federal Transportation Safety Administration (TSA) security officers; and

     WHEREAS, since medical use of marijuana is not recognized under federal law, TSA screening may lead to the confiscation of medical marijuana and the arrest of qualifying patients; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, that the United States Congress is requested to enact necessary legislation to allow qualified patients to transport medical marijuana and paraphernalia for personal use when traveling interstate; and

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the President of the United States

Senate, the Speaker of the United States House of Representatives, and Hawaii's congressional delegation.
