TWENTY-FIFTH LEGISLATURE, 2009
STATE OF HAWAII

WHEREAS, section 232E-1, Hawaii Revised Statutes (HRS), enacted pursuant to the 1978 amendment to the Hawaii State Constitution, established the Tax Review Commission; and

WHEREAS, section 232E-2, HRS, directs the Tax Review Commission to convene every five years, commencing in 1980; and

WHEREAS, section 232E-3, HRS, directs the Tax Review Commission to "conduct a systematic review of the State's tax structure, using such standards as equity and efficiency," and to "submit to the legislature an evaluation of the State's tax structure and recommend revenue and tax policy"; and

WHEREAS, the Tax Review Commission last convened in 2005 and presented its Report of the 2005-2007 Tax Review Commission (Report) to the Twenty-Fourth Legislature during the 2007 Regular Session; and

WHEREAS, since the Tax Review Commission's last report to the Legislature, Hawaii has entered a period of severe economic downturn; and

WHEREAS, in light of current economic conditions, the Tax Review Commission should revisit the evaluations and recommendations contained in its Report; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, that the Tax Review Commission is requested to meet immediately on an emergency basis to discuss updating its Report in light of current economic conditions; and

BE IT FURTHER RESOLVED that the Tax Review Commission is requested to produce an amended report to the Legislature no later than thirty days prior to the convening of the Regular Session of 2010; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Director of Taxation.
