HOUSE CONCURRENT
RESOLUTION
urging the city and county of honolulu to remove care homes from the definition of group living facility.
WHEREAS, Hawaii's population has been aging rapidly and the number of elderly and disabled persons has increased dramatically; and
WHEREAS, at the same time, Hawaii's elderly and persons with disabilities are finding it increasingly difficult to find appropriate affordable housing; and
WHEREAS, the elderly and persons with disabilities should not be discriminated against with regard to housing options; and
WHEREAS, the purpose of this resolution is to urge the City and County of Honolulu to ensure that it does not subject any discriminatory treatment to the elderly and persons with disabilities in housing; and
WHEREAS, laws that discriminates against disabled adults by implementing a spacing requirement is discriminatory since it does not apply to similarly situated non-disabled adults; and
WHEREAS, the Hawaii state constitution explicitly prohibits discrimination against our elderly by prohibiting discrimination based on age; and
WHEREAS, if care homes were included in the definition of group living facility, there would be virtually nowhere an elderly or disabled person could live in Hawaii; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the Senate concurring, that the City and County of Honolulu ensure the availability of adequate housing for our elderly and disabled by removing care homes from the definition of group living facility; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Mayor and City Council and director of the department of planning and permitting of the City and County of Honolulu.
