HOUSE CONCURRENT
RESOLUTION
requesting that the auditor study the feasibility of removing amateur boxing from the jurisdiction of the state boxing commission of hawaii.
WHEREAS, the State Boxing Commission of Hawaii is a board established within the Department of Commerce and Consumer Affairs; and
WHEREAS, the Boxing Commission is vested with the jurisdiction to regulate professional and amateur boxing within the State; and
WHEREAS, in accordance with section 440-30, Hawaii Revised Statutes, the Boxing Commission has delegated supervision and control of amateur boxing within the State to USA Boxing, Inc.; and
WHEREAS, USA Boxing, Inc. is a nonprofit organization that is recognized by the United States Olympic Committee as the national governing body for the sport of amateur boxing in the United States; and
WHEREAS, the Boxing Commission has presented testimony stating that USA Boxing, Inc. is the organization with "the most knowledge and experience in amateur boxing"; and
WHEREAS, the Office of the Auditor is the governmental body that conducts sunset reviews to determine whether regulatory programs are unnecessary to protect the public health, safety, and welfare; and
WHEREAS, one of the criteria the Auditor considers in a sunset review is whether protections, other than the regulatory program in question, already exist that provide adequate protection to consumers; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the Senate concurring, that the Auditor is requested to study the feasibility of removing amateur boxing from the jurisdiction of the State Boxing Commission, resulting in amateur boxing being regulated by USA Boxing, Inc.; and
BE IT FURTHER RESOLVED that the Auditor is requested, as part of its study, to solicit information from the Department of Commerce and Consumer Affairs, the Hawaii chapter of USA Boxing, Inc., the Boxing Commission, amateur boxing coaches in the State, and amateur boxing clubs in the State; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit any findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2010; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor, the Chairperson of the State Boxing Commission of Hawaii, the Director of the Hawaii chapter of USA Boxing, Inc., and the Director of Commerce and Consumer Affairs who in turn is requested to disseminate the contents of this Concurrent Resolution to amateur boxing coaches and amateur boxing clubs in the State.
