HOUSE CONCURRENT

RESOLUTION

REQUESTING THAT THE FEDERAL DRUG ENFORCEMENT ADMINISTRATION RECOGNIZE PRESIDENT BARACK OBAMA'S position ON MEDICAL MARIJUANA raids and stop engaging in medical marijuana raids that circumvent state laws permitting medical use of marijuana.

     WHEREAS, during the campaign leading up to the 2008 presidential election, Barack Obama repeatedly stated that he would not use Justice Department resources to try to circumvent state laws on the issue of medical marijuana; and

     WHEREAS, Mr. Obama stated that he was opposed to using the federal government to raid medical marijuana shops, particularly because it was an infringement on states' decisions; and

     WHEREAS, the 2009 session of the New Hampshire Legislature is hearing legislation to permit medical marijuana, as authorized by state law and the United States Attorney General recently stated that federal agencies would stop raids of medical marijuana dispensers in states where medical marijuana is legal; and

     WHEREAS, however, as recently as February 2009, after President Obama's inauguration, the federal Drug Enforcement Agency continued to raid medical marijuana providers and patients; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the Senate concurring, that the United States Drug Enforcement Agency is requested to recognize President Barack Obama's opposition to use of federal resources for medical marijuana raids and to stop engaging in medical marijuana raids to circumvent state law; and

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Administrator of the Drug Enforcement Agency and the Attorney General of the United States.
