A BILL FOR AN ACT

RELATING TO BEACH ACCESS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-     Beach access; signage. (a)  Any county with a population of more than five hundred thousand shall place signs that clearly identify public beach accesses that have been dedicated for public access by right-of-way or easement for public travel from a public highway or public streets to the land below the high-water mark on any coastal shoreline.  The signs notifying of public access shall be colored blue and white.

(b)  Any county with a population of more than five hundred thousand shall place signs at all public beach accesses that are clearly and prominently located to inform emergency personnel of the location of the beach access point.  The signs notifying of emergency personnel access shall be colored yellow and black.

(c)  A sign or signs approved for use by the county shall be conclusively presumed to be legally adequate to notify the public of a beach access point."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2009.
