A BILL FOR AN ACT
relating to charter schools.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that one of the greatest challenges for charter schools is acquiring facilities. Both a lack of funding for facilities as well as availability of suitable space poses a large obstacle to an otherwise successful part of the public education story in Hawai`i. However, the current budget situation does not appear to allow for additional funding for facilities for charter schools, which is currently not a part of state funding formulas.
One means of providing the opportunity for charter schools to acquire facilities is to give them the ability to use vacant or underused state facilities, such as may be the case if the department of education chooses to consolidate smaller schools.
Accordingly, the purpose of this Act is to give charter schools first priority for the use of vacant or underused state buildings.
SECTION 2. Charter schools shall have the first priority of use of any vacant or underused state building that is available for safe use.
SECTION 3. This Act shall take effect upon its approval.
