A BILL FOR AN ACT


 

 

relating to parking violations.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


          SECTION 1.  Section 291C-167, Hawaii Revised Statutes, is amended to read as follows:

     "§291C-167  Summons or citation on illegally parked vehicle[.]; parking violation surcharge.   (a) Whenever any motor vehicle without a driver is found parked or stopped in violation of any of the restrictions contained in the state traffic laws[,] county traffic ordinances, the officer finding the vehicle shall take its registration number and may take any other information displayed on the vehicle that may identify its registered owner and conspicuously shall affix to the vehicle a citation, as described in section 291C-165, for the registered owner of record to answer as provided in chapter 291D.

     (b)  In addition to any other penalties that may be imposed, a person who violates this section shall be assessed a parking violation surcharge of $15; provided that any money collected for the surcharge shall be distributed as follows:

     (1)  $10 shall deposited into the general fund; and

(2)  $5 shall be paid to the director of finance of the county in which the violation occurred; provided that the state director of finance shall deduct and retain an additional amount equal to ten percent of the counties' share as an administrative fee to be deposited into the general fund."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2009.
